Legal Question in Business Law in Arizona

Website Co. not delivering

I have a signed contract with a Chicago based web developer dated on 1/20/08. They guaranteed completion of site in 9-10 weeks (in writing). We have fulfilled all financial obligations, provided diligent feedback while being extremely patient and congenial. I have many (50+) emails documenting our professional behavior and feedback. Prior to contract we gave detailed outline of site needs. Nothing has changed except removal of some requested functions. However, after a year and 7k later, the site is still not functional and I am not getting any response from the company after repeated emails and phone calls. What are my options?

Re: Website Co. not delivering

You can sue for specific performance under the contract to force them to fulfill their end of the contract. If you don't think this will help as they won't/can't perform anyway, you can always sue for breach of contract and ask for attorneys fees and costs. Where is the venue and jurisdiction of the contract, i.e., what state are disputes to be resolved in under the contract language?
