Legal Question in Civil Rights Law in Arizona

Co-signing a vehicle

My girl friends step father co-sighned for a car for her. Two days ago he came out to Phoenix and took the car back, and said that we would never get the car back. He said we have two weeks to give him 6,500 dollaers or else in two weeks he's gonna pay the car off and sell it. What are our rights. He has paid nothing for the car. Can he dothat??

Re: Co-signing a vehicle

If there is a history of late payments and/or the loan is in arrears, then he may be able to take possession of the collateral to protect his liability as a co-signer.

If the loan is not in jeopardy, then he has no legal right to do as you describe.

Under either set of facts he is not entitled to demand money from you unless he has paid out money on your behalf.
