Legal Question in Technology Law in Arizona
Pictures of Children Posted on Website
My wife and I published a personal website for friends and family. I posted pictures of my kids, daughter age 18 and son age 15, they are from a previous marriage. The pictures of both children are of them as infants and 8 to 10 years of age. My daugher is threatening to sue me if I don't remove her pictures and all reference of her from my page. My ex-wife is threatening to sue if I don't remove my son's pictures and all reference of him. My ex-wife has custody of our son. Have I violated anyone's rights or invaded anyone's privacy in what I have done? If I need to remove the pictures, do I also need to remove the reference to my children? Thank you.

Re: Pictures of Children Posted on Website
Each of us has a privacy and property right in our personal image and no one has the right to utilize that image against our wishes. This concept is often lost in family considerations, but under the circumstances you describe it is better for you to remove photographs of the objecting children from the website than to compound family disharmony and risk losing a lawsuit.
