Legal Question in Technology Law in Arizona
Wrongful Deletion of Internet Account
My husband and I were separating (in good terms), so I called our internet service provider and instructed the representative to replace my husband's name in the next billing statement with my name instead. The representative fulfilled my request. The following day, my husband and I could not access our emails. When we called our provider, we found out that: 1. The representative deleted my husband's account and therefore, our emails were permanently lost; 2. That the representative shouldn't have altered my husband's account without speaking to him and getting his permission; and 3. The representative did not inform me that he was going to delete my husband's account, and that it would result to the loss of our saved emails. I have filed a complaint with our local BBB, but our internet service provider's admission of their mistake, they only offered a free month's subscription. We declined their offer, because we did not feel it was a fair settlement. We have not heard from them since. I would like to know if we have any legal grounds to pursue this case further. Thank you for the advice.

An attorney would need to read the Terms of Service of your provider to know what your options are.
