Legal Question in Constitutional Law in Arizona
is it legal for the cop and fbi to enter my home without a search warrent and make me leave the premises of my home then when they called be back on my cell to come back home is when they gave me a search warrent
1 Answer from Attorneys
No it is not legal for law enforcement to enter a home without a warrant (absent certain exceptional circumstances). But it sounds like they may have had a warrant but did not show it to you until later, which may or may not be an issue. Did they find evidence that is being used against you in a criminal case, and if so do you have a lawyer? A lawyer will learn the details, apply the law, and advise you of your options. If the agents truly entered your home without a warrant and there were no exigent circumstances, they may have a problem. But more details are needed for a full assessment.
