Legal Question in Consumer Law in Arizona
Pool company states they are filing Bankruptcy!
We started pool construction July 2007 and our contracted pool company stated completion would be about 12 weeks. Progress on the pool slowed down drastically. We began questioning the pool complany. Today the company called and stated that they are going out of business and filing bankruptcy. The owners say they are going to try to finishing our pool that is 3/4 finished. What should we do? Do we just take the loss or do we have legal rights to making them honor a contract when there is a bankruptcy in their plans?

You need to find out if the company is filing bankruptcy under chapter 11, which is a reorganization of the business (staying in business) or a liquidation/close down under chapter 7. Ask the pool company if they can give you more info.
