Legal Question in Consumer Law in Arizona
Wrongfully Served
I was served papers regarding a case in New Jersey. The name and address on the papers is the same as mine, but the social security number is not, nor is the date of birth. I called the law offices serving me and they want me to send them info proving I am who I say I am. Is the burden of proof on me, or is it on them? Am I required to send or do anything? Thank you.

Re: Wrongfully Served
When a person is sued for a debt outside where the contract was signed or in a location other than where the consumer resides it may lead to a violation of the FDCPA.
This is a problem that you may want to get an attorney involved with. Feel free to contact my office if you have any further questions or wish to discuss this in more depth.
