Legal Question in Credit and Debt Law in Arizona
car title loan
I took out a title loan in az. Relocated to nc. A year later the title loan company is threatening to take me to court for the unpaid amount. He stated that I broke the law for taking the car out of state. I told him that I had told them that I was moving and that after I got to nc they faxed a copy of my title to me so I could get it registered. If I broke the law then why would they do that. Well anyway, he said that they are going to garnish my wages. I have been unemployed for almost 3 mos. and fear that once I land a job they will take my money. Can they do that. I know this is involving 2 different states on both coasts but I am completely lost. If they take me to court in Phoenix, and I can't get there then will there be a warrant out for me? Boy do I feel dumb. Please help me.

Re: car title loan
If they sue you in Arizona, and you don't show up, you will lose by default and they will get a judgment against you. If you own any property in Arizona, then they can enforce the judgment against that property. In order to get to your property in NC, they would have to get the judgment "domesticated" in NC by a NC court.
Whether or not wage garnishment is available in NC, I don't know. Perhaps a NC lawyer will respond to that issue. (In Arizona, the answer would be yes, they can garnish wages with a valid judgment.)
