Legal Question in Credit and Debt Law in Arizona
Hello, I think a collection agency is trying to sue my wife and is attempting to serve us. Some one showed up at our house today( with out identifying himself or what he wanted) and held out a piece of paper with a name on it and asked my wife if this her. The name was very close but was not her name.( It was off by a couple of letters). She said no since the name was not her. He asked her her name and asked her she sign the paper saying that it was not her. She said since she doesn't know who he is or what he wants that he needs to leave. So he did. Did she do anything wrong since we think it probably was for her but since the name was wrong she refused and did not offer the correct spelling or is that there collection agencies responsibilty to get it right? Thanks for any info you can give us.

The person was, most likely attempting to serve you with a lawsuit - you are correct. Technically, you may be able to make an argument about the letters being off, but that is not the real issue. You cannot avoid this lawsuit. I would be happy to discuss your options legally about this debt. A bankruptcy could be in your best interest. Regards, Matthew R. Eggleston, Esq.
