Legal Question in Credit and Debt Law in Arizona

Debt around a divorce

My wife got divorced 2 .5 years ago. She ust got served w/ papers regarding two loans that ex verbally agreeded to pay (in divorce) and defaulted and ex took out a 9k loan after divorce that defaulted as well. The case is from 6 months ago. Today is the first we heard of it. Last week ex quietly mentioned he was filing bk. Does she have any liability for debt after the divorce (debt in AZ divorce in CA)? Can we assume that a ''verbal'' agreement to pay the other debts does not matter even though she is paying the debt that she verbally agreed to?

Re: Debt around a divorce

I'm a bit confused by your post, however, if she is filing bankruptcy, any legal basis for her liability for these debts is irrelevant. When she files, she needs to list all debts and they will, assuming she files chapter 7 and nobody objects to her discharge, be discharged. Whether she is legally liable for the debts or not requires a thorough review of a lot more facts than were given in your post, so it is very hard to say. Additionally, the issue of liability is probably a question of AZ law if the debt was incurred while living there.
