Legal Question in Credit and Debt Law in Arizona
We recently contacted the Company we purchased a Security System from because we had finally met the 3 year contract aggreement and were waiting to cancel. We were told by the company to just send a letter stating that we were canceling our service. Shortly after we recieved another bill for another years service. We called again and they said that we had to cancel 30 days prior to the end of the contract or we would be automatically revewed. To date we canceled our checking account that the company was withdrawing monthly payments from and now they continue to call and send bills for 3 months and now a collection agency has sent a letter asking for immediate payment of 3 more months of service. How do we end this nightmare? We are also losing our home to foreclosure and have this hanging over our heads now to. Thank you for any help, Mary & Jim
1 Answer from Attorneys
At the risk of sounding self-indulgent, you need an attorney! Obviously these folks don't care enough to properly process the paperwork, or someone dropped the ball. Try and find an attorney that will handle a simple demand letter and phone call for you. Collection companies cannot contact you directly once you have an attorney. They are required to call the attorney. Getting a lawyer involved will usually slow things down and allow a third party (your lawyer) to sort through the mix up. If it does proceed to court action, you can likely represent yourself and your lawyer can help you prepare.
Find an attorney who can work with your budget and hand this one off to him or her so you can worry about something else.
