Served about Credit Card

Hi,

I was served this weekend concerning a debt owed to a credit card company. I spoke with the lawyer today and worked out a deal. However, he still states they are continuing the lawsuit. He said that if I didn't file my written notice in 20 days they would do so. Is it best for me to respond with the writen notice and pay the fee for that or is it necessary?

I always advise filing your answer to a lawsuit. If you do not file an answer, the court will generally accept everything in the complaint as true. The attorney can then request an entry of default against you.

One option is to wait the 20 days and see if the attorney does anything. If they file for an entry of default, they have to mail you notice and you have another 10 days to answer the complaint.
