I sold a vehicle to an individual with the understanding of a signed contract that she was to make payments. She only made a couple of payments and I was getting ready to file a small claim when the vehicle was impounded by the Gilbert Police Department. I'm going to try to get the vehicle back but there are fees payable to the police department, a hearing that I will need to attend, insurance towing and storage fees. My question is if the Gilbert Police grant me the right to take my vehicle back and I pay all fees incurred can I then take her to small claims court for the balance due on the vehicle and all other expenses?

Your damages for the other party's breach of contract would include all of the payments you would be required to make to get your car back. Please keep all receipts for any fees you are required to incur.
