3rd Time Drug Possession

In the year 2000, I was busted twice within 7 days for possession of dangerous drugs and drug paraphanellia. I don't know why the courts decided to combine the 2 incidences, but they did. I was put on the courts diversion program for one year and past all the court requirements. My charges were reduced to a misdemeanor and since then my records are sealed ''with prejudice.'' Last week I was busted for the same charges again. What is going to happen to me? I have a malignant brain tumor and do not want to spent my last days in prison.

Your prior 'diversion' efforts should not count as convictions so as to place you in prison eligible situation. This does not mean that you might not be subject to substantial jail time, paticularly with the new county attorney administration that is in place.
