Legal Question in Criminal Law in Arizona

My 15 yr old Nephew and his 13yr old girlfriend were caught having consensual sex by her Father in Arizona. He is now facing three felony charges? I don't understand why he could be facing felony charges if they were both minors and it was consensual. Also, I'm told if found guilty he may have to register as a sex offender? He is 15. What is the law regarding minors having sex with minors?

By law, a 13 year can't consent. This is statutory rape. If convicted, his is facing mandatory prison. And, if convicted he will be required to register as a sex offender. You should consider retaining an expert in criminal law such as myself to represent him. Please call on Tues.

Mr. Snader is correct. There is no such thing as consensual sex involving a minor. Regardless of how willingly they engage in sex or how young their partner may be, the law does not allow them to consent to sex. Any such consent they try to give is legally invalid.
