Legal Question in Criminal Law in Arizona

13 yr old questioning

My granddaughter was accused of making a bomb threat at her school. The police took her from school and now she is a detention center. Her parents were never notified of anything until hours after she was at the dentention center. Shouldnt they have been notified they were going to talk to her and what was happening?

Re: 13 yr old questioning

The law only requires that the juvenile be informed that they can have a parent present. If not requested, there is no obligation to immediately call the parents.

This sounds like a very serious situation. If you are looking to hire private counsel, please contact me.

Re: 13 yr old questioning

In NJ, courts do not allow questioning of children under 14 without a parent. You need an attorney to find out what the law is in AZ. I suggest your attorney use some out of state law in his motion to kick out the confession.

Good luck!
