In Arizona, felony charges (ie Burglary in the 3rd Degree) generally have a seven year statute of limitations for prosecution. It is quite possible that the police agency wanted more time to investigate the incident. However, there are legal issues with keeping a person in jail. Therefore, it is not uncommon for charges to be dismissed, and then re-filed once futher investigation has been done, but there are legal procedures that should be followed when this occurs. You should consider hiring an experienced defense attorney to review the situation and specific facts.
