assult charges

could I get a asult charge for spitting at someone knocked down to a tresspassing charge ..I was on public property?

First of all, it depends on the jurisdiction's definition of assault. Where I have worked there has to be bodily injury or severe physical pain for a criminal assault charge to stick. If it's a civil claim of a tortious assault, that's different; that just has to be an unwanted touching or anticipation of imminent physical harm. And it depends on what the prosecutor is willing to do, if it's a criminal charge; they may be willing to knock it down to public trespass, I don't know. I would consult with a criminal defense attorney.
