What is the law regarding bad check writing in Az? and how do they prosecute for first time offenders? (Being charged with a felony for under $5,000 and can show no intent- does that matter?)

Issuing a bad check under Arizona Statute 13-1807 is a class one misdemeanor, punishable by a maximum of 6 months confinement and a $2500 fine. You may be offered a diversion program for a first time offense, whereby you agree to pay back the money and go through some classes.
