Legal Question in Criminal Law in Arizona
i bonded my boyfriend out and used my car as the collateral he skipped town and of course the bondsmen want their money but they want cash can i use my car to cover the debt since thats what i used for collateral?
1 Answer from Attorneys
You owe the bondsman money, not a car. He is allowed to take the car if you fail to pay, but that does not mean you are excused from paying. The bondsman may claim the collateral if you breach your contract. Failure to pay would be a breach. Surrendering the car is not a way to *comply* with the contract. What's more, if the bondsman takes the car but get less from selling it than you owe, you will still have to pay the rest of what you owe.
You can offer the car to the bondsman instead of cash. He might think that's a fair deal. But he does not have to accept the car instead of the cash payment you agreed to make.
