Legal Question in Criminal Law in Arizona

I was charged with a class 2 felony theft. The Plea bargain received is for class 6, full resititution 34k, 90 days jail with work release and 1 year probation. Can I ask prosecution to consider no jail in plea bargain so I can take care of my sick wife currently on FMLA and kids? This is a first offense no criminal record at all. And how do I request just the probation?

You should not represent yourself in any criminal case, let alone one involving a felony. That being said, a plea bargain is contract. It sounds like the prosecutor has made you an offer. Your attorney, or you if you represent yourself, can always make a counteroffer. Whether the prosecutor responds favorably is another question; there are risks since there is no requirement that any settlement offer be made, and one that has been made can be revoked. Again, my advice is to seek counsel.
