can you be charged with misconduct involving weapons even if the weapon wasn't on you, it was about 30 to 40 yards away from me it was one of my buddies when he saw the cops he ran toss the guncops never found himand charge me with that all of this started because they said the vehicle we were in was speed

The answer to whether you can be "charged" is "yes". On the other hand, the answer as to if you can be convicted at trial is a different question.
