Legal Question in Criminal Law in Arizona
Some one was charged under the stalking law in arizona. The guy's ex girlfriend took an RO against him. The guy had no notice that she did. He was arrested and the judge did not accept a plea. He was granted bail. To attend to his ailing mother he left USA. Now he wants to come back but does not want to be victimized due to bias as he is a muslim. He had no prior records. He studied at uni. Of arizona and subsequently worked for a prestigious company. Now he is in trouble because of his ex girl friend. What possible solution he has to resolve this amicably outside and inside the court. How long will It take and what will be the procedure. Thank you.

First, in order to be charged with violating an order of protection, one has to have notice and be formally served. If this did not occur, there is a valid defense. If the person has left the country while a criminal case was ongoing, there may well be a warrant for his arrest. The Court may decide not to give him bail this time. It sounds as though there are also immigration consequences, so a conviction may result in deportation. With regard to an "amicable" resolution, have successfully handled these cases before both by settlement and by jury trial, I can tell you that mounting an aggressive defense is your best offense. Your friend will clearly need counsel. Right now it does not sound as if he is entitled to have counsel appointed, but he can always hire his own attorney. Call me if you are interested.
