Confidential source wearing wire ,Is it legal
When a arrested person agreas to work w./ the Secret Service to wear a microphone or wire into a person home to set them up. wouldnt the Secret service have to obtain some sort of court order before hand?

No. There is no legal prohibition against tape recording a conversation with the permission of only one party to the conversation when done in person.
CI's wear wires most of the time. That's what makes them CI's.
There is nothing illegal in what you report the SS is suggesting.
