Legal Question in Criminal Law in Arizona
Connecticut 1976
A 16 year old boy is convicted of burglary and rape along with 2 other boys. Tried as an adult he is sentenced to 8 years. He did not participate in the actual rape, but was an accessory. While in prison there was a prison riot which he was involved in. A guard was injured, but not killed due to the efforts of this young man. On his release he was not required to register as a sex offender.
Many years later he moves to Arizona, gets stopped for dwb. The officers run his name and find the old conviction. They tell him that Arizona has 0 tolerance and here he has to register as a sex offender. He goes to the court house to register and they tell him he has to have a court order, he doesn't have one and the descriptions of offenders required to register do not fit his case so he doesn't do it. A short period of time elapses. The police go to his home, tell him again he has to register and threaten to distribute flyers to his neighbors about his record. His wife and child were terrified by the officers in the middle of the night.
To protect his family and his neighbors from this situation he goes back to the court house and jumps through numerous hoops and gets himself registered as a sex offender. Which stops him from working as a CNA for which he has been trained.
He has had no other problems with the law except traffic tickets through all of 35 years. Is there any remedy to this situation.
