Legal Question in Criminal Law in Arizona
How would I go about getting the courts to extend my sons sentencing date? My Father wants to attend for family support, however he has eye surgery scheduled for the same day and cannot re-schedule.

A person being sentenced is entitled to a continuance for a mitigation hearing. Mitigation hearings include family members attending sentencing for family support. Your attorney should simply ask the Court to continue the case for mitigation. However, Judges normally only allow one or two continuances for sentencings unless there are extraordinary circumstances. You should be able to request a continuance any time before the date of sentencing and even at the sentencing hearing itself.
