Legal Question in Criminal Law in Arizona

my stepson is charged with 2 counts of agg.assault and 1 count of assisting a criminal street gang. There are 3 victims, 2 are pressing charges and the 3rd refused to. The 2 victims that are pressing charges were not even hurt in the incident and they didnt need medicl attention. Isnt a class 2 felony for aggravated assault to harsh of a charge, for a victim of a crime that wasn't even hurt?

The local trend here in Phoenix is for the County Attorney to overcharge cases. It really isn't an issue if anyone was hurt or not. They just go for the harshest charges possible and try and force plea bargains.
