daycare assistance fraud

In May 2003, i applied and received assistance from the state to help pay for childcare so that I can work and put food on the table. On the application I wrote that my husband was not living with us, which he wasn't. I also wrote on the application that he took care of the mortgage for the house we lived in. Someone called and told them that my husband was living with me and that I lied. If you can call coming by the house whenever he felt like it and sitting around drinking, living there. His mail also came to the house because he was moving from one friends house to another, the state is saying that because he never gave a fowarding address, that means this was his address and now I am being charged with a felony, even though I did not lie. What do I do?????

Consult a criminal defense attorney at once. Initial consultations are usually done at no cost. Ask first. If you don't know any lawyers, contact the AZ Bar Association for referrals. Do not delay. A felony is a serious matter, and you could be required to return some money. If after consultation you find you cannot afford a lawyer, contact the public defender. The Clerk of Court will tell you how to do this, and the PD is in the phone book.
