Legal Question in Criminal Law in Arizona
employee theft
an employee in a position of trust and accress to bank statements and business checks wrote several checks to himself with no supporting documentation. The amount in question is several thousand dollars. The employee is no longer with the company due to suspected ''kickbacks'' from our suppliers. Is it necessary to prove the employee did not spend the money for company business before we can seek legal redress or does the employee need to prove he used the money for company activities?

No. This appears to be a clear case of embezzlement. You need to speak with local police and pursue and investigation for criminal charges. This would make an eventual civil case easier and may get you restitution without spending a ton of money to pursue the civil case. Please call me if you need more specific info.
