Legal Question in Criminal Law in Arizona
Okay, say a girl is 15 almost 16 and she had sex with a boy who is 17, her parents found out and now he wants to get the boy for statutory rape, in the state of Arizona would her dad have something here? Was it statutory rape?

Without commenting on whether sex at those ages is appropriate, and assuming the boy is no more than 24 months older than the girl, the answer to the question is "no" it is not statutory rape.

F. It is a defense to a prosecution pursuant to �� 13-1405 and 13-3560 [that is, having sex with a minor] if the victim is fifteen, sixteen or seventeen years of age, the defendant is under nineteen years of age or attending high school and is no more than twenty-four months older than the victim and the conduct is consensual.
