Legal Question in Criminal Law in Arizona

Grand jury warrant for fraud

My boyfriend was arrested on 12/29/06 on a grand jury warrant. The open charges were i count theft bond $10,000.00 and 1 count of fraudulent schemes. He was out on supervised release in which he has to go on 1/2/07 to obtain a probation officer, he got out at 4am on 12/30/06. He is 27yrs old, does not have any priors, and he has never been in trouble. We think this might be a a check that bounced by accident (i promise by accident) back in Sept. of 2005. My question is when they arrested him they never read him his miranda rights, but they also didn't question him or obtain a statements, so in this situation do they police officers still need to?

Re: Grand jury warrant for fraud

Miranda rights only apply if they interrogated him about the charge for which he was arrested. Typically when there is a grand jury warrant, the investigation is over so there is no need to question a suspect. I handle a lot of fraud case and am very familiar with both the system as well as the prosecutors on the other side. If you are looking to hire counsel (and now is the time to do it) feel free to give me a ring at (six zero two) two two two - nine two three seven.
