Legal Question in Criminal Law in Arizona

Honest answer on job application

While living in Arizona and married to her first husband, myfriend caught him in bed with another woman. She was angry and wanted to get the woman she befriended ''back''. She piled up all of her clothing and poured bleach over them. She then proceeded to take apart the woman's computer rendering it completely inoperable. She was charged and convicted of felony destruction of personal property.

The conviction as been set aside. She intends to apply for a job with the EPA. When she fills out her job application, does she have to mark ''Yes'' when asked ''Have you ever been convicted of a felony?'' Does she have to mark ''Yes'' to the question ''Have you ever been convicted of a crime?''

Re: Honest answer on job application

Not enough information to give a solid answer, but if the conviction has truly been "set aside", as in reversed and dismissed on appeal, or vacated by the court, resulting one way or the other in a finding of not guilty, then, it would be as if she was never convicted, and could honestly answer "no" to any prior convictions.
