Legal Question in Criminal Law in Arizona

My husbands ex wife called the airline that my stepsons were scheduled to travel home on and impersonated me in order to change their reservation two days before scheduled departure. She used my funds to do so (I had a credit with the airline from a previous cancellation) the charge was $295. We have her on tape (Arizona has a one party to the call law) admitting that she had done so, taunting my husband with the information.

The airline confirmed to us that she called in using my name and my money and advised us to contact law enforcement which we did. The officer informed me that he will send a report to the Arizona Police Department in the county she lives in. We also have an email from the airline showing that she used my name with a time and date stamp. We live in California. We first called our County Sheriff who took the report and advised us to call the Arizona county where the crime took place. The Arizona Police Department Fraud Detective told us that he feels this is not fraud but a custody matter. This is confusing to me, it had nothing to do with custody. She used my identity to access my funds to change a reservation. Confused??? What do I do?

Based on what you are saying, you are correct in assuming she violated several felony statutes. Whether it was a fraud scheme, forgery, identify theft, all are felonies. If you have it on tape, I am not sure why the police agency is causing you grief.

You will need to contact the law enforcement agency in the city that the crime occurred. I assume that the case is at sky harbor airport in phoenix. You should be contacting the phoenix police department.
