Legal Question in Criminal Law in Arizona
indicted for drug charges
i was charged with allegations of drug manufacutring, 5 counts. I served time in jail, went to rehab, and was on probation for 16 months. Charges were later dismissed. Now I am being charged with the same allegations but as indictments. How can I be charged for an offnes three years old and already dismissed?

Statute of limitations for Manufacturing Dangerous Drugs is 7 years. You were probably offered T.A.S.C. for Possession of Dangerous Drugs and subsequently Indicted for Manufacturing, Possession for Sale etc. Even if these offenses stem from the same incident mere possession is not a greater offense of manufacturing and or sale. Therefore double jeopardy is not applicable.
