Legal Question in Criminal Law in Arizona
How long will a case stay active if there are no cooperating witnesses and no evidence even if the police are determined not to let it go?
1 Answer from Attorneys
There is usually a statute of limitations -- a time period during which criminal charges must be filed or no action can be taken. There also is what is called a reasonable time period in which to prosecute. This is usually a year or two at most although it varies depending on the complexity of the case. If no charges have been filed and the statute of limitations on the type of charges that might apply has run, you're home free. If there is already a criminal proceeding against you, it needs to be vigorously prosecuted; that is, they have to have regular hearings and move it forward to trial or a plea offer...some kind of resolution, any kind of resolution. Best of luck!
