Legal Question in Criminal Law in Arizona
A man burglarized our home using his company truck to haul away the loot. Is his employer liable for damages along with the employee for paying for fixing the broken window his employee broke to enter the house? Thanks.

As a crime victim you have rights under the Arizona Constitution. One of your rights is that you are entitled to restitution for all financial loss arising out of the crime committed. This should definitely cover your loss regarding the actual defendant if he was convicted. Any plea agreement should contain restitution language on your behalf. Regarding the defendant�s employer, you may have a claim under the theory of vicarious liability because the defendant used his company truck to commit the offense. However, there are certain issues that need to be addressed such as the scope of the defendant�s employment.
