Legal Question in Criminal Law in Arizona
How does a person go about getting misdemeanor violations expunged from their record? How old must a violation be before it can be cleared? And what, if any, are the exceptions (for instance, DUI)?
1 Answer from Attorneys
AZ unfortunately doesnt have expungements (by and large). We have a program called "set aside". It is a Judicial dismissal of the charges. A convicted person is generally eligible once they have completed the terms of their setence.
DUI's are eligible for the set aside program. It is important to know that the bench that sentenced you initially is the one that determines the set aside (each Judge has a separate policy about when they are willing to grant them). Speaking to an attorney who deals with the Judges on a daily basis is highly suggested.
