Legal Question in Criminal Law in Arizona
Can i be prosecuted if no witness at trial?
My boyfriend was charged with Assault for hitting me once, but i didn't tell the cops that he only hit me because i was hitting him first. He also didn't tell them that i was, because he didn't want me to get in trouble. I got the police involved because i wanted him to get scared. I didn't want to press charges, but since i'm 17 they got my legal guardian to press charges. I moved out of state since then, so When he goes to trial because he plead Not Guilty, and since they can't subpoena me, the only witness over state lines, will it be dropped like i want? Or are they able to charge him anyways, and on what basis? Rebecka
