Can a prosecutor charge someone based on their own suspicion?

No, the prosecutor can only change someone with an offense if they believe that probable cause exists to support the charge. However, many will not charge a case unless they believe they have enough evidence to secure a conviction. That requires that they prove their case beyond a reasonable doubt.
