Legal Question in Criminal Law in Arizona
I received a misdemeanor DUI in 2008 along with a misdemeanor paraphernalia charge I paid off most of my debts but still owe $2000. I was reading about deferring court payments if you can prove you are financially unable to make the payments and you have completed your probation then you can file papers to wipe your fees then apply to expunge or dismiss the charges on your record so they don't come up in a background check... I'm having a hard time getting a job would this be possible to do or would I just be wasting my time . ?

In all honesty, wiping a charge is somewhat useless. An employer could request that you disclose all previous charges, even those which have been removed from your record and you would need to be honest in your reply. I believe that attempting to wipe out a charge is mostly useless as there are always ways for employers to find the information out since the charge is still kept in records which could be revealed via a background check. However, to put your mind at ease, most courts and police stations expunge records older than 7 years as is. Furthermore, most employers do not frown upon a previous DUI, especially a misdemeanor, so long as you are honest about it and inform them that you are regretful for your actions. I hope this help. Ultimately though, if you are adamant on getting the charge removed or wiped out...I would contact an attorney to aid you in doing so. But first...weigh your options. We can be expensive.
