Legal Question in Criminal Law in Arizona
Request for dismissal
What types of forms can be filed for someone to be released from jail? There is no physical evidence and ultimately no witnesses. The one ''witness'' has told police 5 different stories. The prosecution still wants to take this to trial because they believe the statement from the witness is enough to prosecute. Can a request for dismissal be filed? If so what type of request would need to be filed? This is a murder case

Re: Request for dismissal
You can request the judge to review the release conditions based upon material changes since the last ruling. There is also a Habeas Corpus petition if he is being confined illegally.
