resisting arrest

I plead no contest to a dui in August of 2008 did my jail time and I am paying the fines. I thought it was finally done with it. But I just received a certified letter of a direct complaint to go to court in 3 weeks for a resisting arrest. the officer had told my husband that he was not pursuing charges. How can they do that after I already went through the process with the dui. .

Unless the resisting arrest charge was dismissed under the plea agreement you entered into for the DUI charge, the prosecution will probably be able to file it as a seperate offense. Resisting arrest is a felony charge with drastic potential consequences including prison time. It happens regularly as they are separate offenses. The key would have been to have the DUI agreement preclude further charges. Someone missed that. At this point though, the new felony charge if far more serious and needs to be dealt with aggressively. This is the type of case I do on a regular basis and have very good results.
