Sexual Misconduct with a Minor

A male age 17 has consensual sex with a female 15, and is than charged as a minor with sexual misconduct. The case is then dismissed with a prejudice. Two weeks after his 18 Birthday the charges are reinstated and he is in Pima County Correctional Facility. I heard that it was because she was under the age of 16 (the legal age of consent), could that be the case? They were both minors at the time of the act so I do not understand how it is sexual misconduct with a minor as he was also a minor. She is now pregnant, and there is a possibility of the child being his. The date of conception would be sometime mid-October. He is willing to financially (on his little income) aid the mother if it is in fact his child. He is not a bad kid and would not force himself upon anyone. Is there any advice you can offer? Can you offer any suggestion for an attorney? Could the fact that she is now pregnant have anything to do with this?

The case was dismissed without prejudice as they were able to refile. FYI- the Pima County Attorney is known to be somewhat ruthless on sex cases, even if it was a consensual situation.
