You have been charged with Theft. A person violates ARS 13-1802(a)(1) if, without lawful authority, the person knowingly controls property of another with the intent to deprive the other person of such property. Generally, a felony or misdemeanor classification is dependent upon the value of the property taken. See ARS 13-1802 for additional details. If you have been charged in the Superior Court, the court will schedule a series of pretrial hearings to ensure that your case is progressing. At these hearings, the parties may discuss any of the following: release conditions, discovery, possible plea negotiations, evidentiary issues and other pretrial and trial issues. If your case is not resolved by plea agreement or dismissal, you will proceed to trial. It's important to talk to your attorney in more detail about the specific facts and circumstances in your case before you proceed. Best of luck to you.
