Legal Question in Criminal Law in Arizona
Can They Do That??
My Son Was Arrested A Year Ago In Nebraska For Sexual Contact With A Minor. He was charged with a misdemeanor and sentenced to two years probation and register as a sex offender for 10 years. He has sense moved to Arizona, after visiting with his probation officer,(In Arizona) He informs my son that Arizona Does not have misdemeanor sex offenses. That they will have to change the misdemeanor charge to a felony and that he will have to be a registered sex offender for life. I do not think this is right or fair he was convicted of a misdemeanor Not a felony. Can they (Arizona) do that? Thank you, Father in need of advice

No. Your son in in AZ via the interstate compact, a provision that allow supervision in a state other than the sentencing state. He is still under the jurisdiction of NE no matter where he is, and AZ cannot modify the terms of probation. I handle numerous sex offenses and probation violations related to sex offenses.
