This section of the criminal code is for the Unlawful Failure to Return Rented or Leased Property, a class one misdemeanor which carries a maximum sentence of six months in jail, a fine of $2,500 plus 83% surcharges, and three years of probation. If charged with violating this section, you would be facing arraignment on this charge in court before a judge; therefore, you would more than likely be going to court and see a judge.
