Legal issues will turn on several factors, including: what you were stopped for, the fact that you permitted the police to search your car, whether you were already under arrest for something else at the time, where the pills were, and other relevant facts. Whether you should have been told or not also depends on lots of factors. You should consult a criminal defense attorney to review the specific facts and potential legal issues with you.

Ultimately, it is the prosecuting agency in your jurisdiction, not the police, who will determine what charges to file against you. As long as probable cause exists to support the charge, the state can add charges subsequent to your arrest. It's best to consult an experienced criminal defense attorney to review your case for legal and constitutional violations and ensure the best possible results. Feel free to call with additional questions. Good luck!
