Legal Question in Criminal Law in Arizona

suspension of charges

I did not have a criminal record when I was charged with dv misdemeanor assualt and disordrly conduct. The prosecutor made an agreement with me that if I took an anger management course and paid $135 dollars to domestic violence charities that I would receive a court dismissal during a 60 day period. I completed those requirements but during the 60 days I was charged with driving with a suspended license. I was not booked. The license was suspended for civil traffic unpaid fines. Since receiving the traffic charge, I have paid my fines and had my license reinstated. However, the prosector decided to resume prosecution of the dv charges because of the traffic charge. I will be meeting with him next week for the pretrial conference scheduled for the traffic charge. Considering, my clean record, my license reinstatement, and my completion of anger management, and payment of fines, is there a good chance I can still receive a dismissal of the dv charges?

Re: suspension of charges

Usually it is also a requirement of the suspended prosecution that you obey the law. It's up to whether the prosecutor can be convinced to still give you the dismissal. I would say that right now your are behind in the count as the prosecutor has already chosen to resume the prosecution.
