What is the longest you can be held prior to starting trial? When trying to file Murder 1 charges, what type of evidence do they need to have. Currently they have word of mouth that someone was there but no concrete evidence such as DNA linking him to the scene, no motive-besides possible robbery, and no weapon. There is an innocent person in jail being accused of murder. He was picked up in December and the judge wants the trial to begin by Aug 28th. He said he is not impressed with the evidence the law has against him, what other evidence would they need to link him to the crime or charge him with the crime?

It takes time to prepare for a trial as witness need to be interviewed and other investigation needs to be done. This said, a private attorney often has more time to be diligent about doing this and getting the matter to trial quicker.
