Legal Question in Criminal Law in Arizona

undesignated offense

The state of Arizona decided to charge me with Statutory Rape but I accepted a plea bargan of ''unlawful inprisonment, A class 6 undesignated offense'' and had to serve 3 years of probation. I served only 16 months of probation and was granted a early termination of probation and recieved an ''Order of discharge from probation.'' The document also stated that ''IT IS ORDERED THE UNDESIGNATED OFFENSE BE DESIGNATED A MISDAMEANOR.''

Although, when I applied for a coaching position at a local middle school a couple years ago I was denied. I was informmed by the clerk of the court that I had a charge of ''sexual conduct with a minor'' on my record and I would have to speak to my probation officer who is no longer working for the state. I will be graduating from college in several months and I am deeply concerned with what my criminal record will display when a background check is done by potential employers.

You are technically correct on everything. The background check done seems to be looking at your NCIC arrest record. The situation may be able to be rectified. It will be bit of a finesse situtation. I handle a significant number of sex crimes cases and am familiar with this dilemma. Please contact me for further assistance.
